1. General Agreement

By signing a rental agreement or booking through our website, app, or office, you agree to comply with all terms and conditions outlined here and in your rental contract. You confirm that:

• All information provided is accurate and truthful.
• You hold a valid driver's license and meet our rental requirements.
• You are responsible for any authorized or unauthorized use of the vehicle during your rental period.

2. Eligibility

• Be at least 21 years old.
• Have a valid driver's license held for a minimum of 2 years.
• Present a government-issued Driver's License and a credit or debit card in your name at pickup.
• Renters under 25 years old may be charged a young driver surcharge.

3. Reservations & Payments

• All rentals are subject to vehicle availability.
• Full or partial payment may be required at the time of booking.
• A security deposit is required at pickup and refunded after the vehicle is returned in good condition.
• Accepted payment methods include major credit cards and debit cards.
• Prices are quoted in United States Dollars (USD) unless otherwise stated.

4. Cancellations & Modifications

• Cancel or modify your booking up to 24 hours before pickup for free.
• Cancellations made within 24 hours of pickup may incur a fee.
• "No-shows" are treated as late cancellations.
• Explorers Auto Rental Ltd. may cancel bookings due to unforeseen circumstances (e.g., vehicle unavailability, safety concerns).

5. Vehicle Pickup & Return

• Present all required documents and the payment card used for booking.
• Vehicle inspection completed with a team member before departure.
• Return the vehicle to the agreed location and time.
• Late returns may incur additional hourly or daily charges.
• Vehicles must be returned in the same condition and fuel level as rented.

6. Use of Vehicle

Vehicles must be operated responsibly and only for lawful purposes. They must not be used for:

• Off-road driving or racing.
• Transporting illegal goods or substances.
• Carrying passengers or goods for hire or reward.
• Towing or pushing another vehicle.
• Driving under the influence of alcohol, drugs, or any impairing substance.

Explorers Auto Rental Ltd. may terminate rentals immediately if the vehicle is misused.

7. Insurance & Liability

• Each rental includes Basic Coverage as required by law.
• Optional Full Protection and Third-Party Liability coverage available for purchase.
• Renter responsible for damage, theft, or loss not covered by insurance.
• Notify Explorers Auto Rental Ltd. and police immediately in the event of an accident.

8. Traffic Violations & Fines

You are responsible for all parking tickets, tolls, traffic violations, and related fines during the rental period. Explorers Auto Rental Ltd. may charge your card for such fees plus an administrative charge.

9. Breakdown & Roadside Assistance

Roadside assistance is available 24/7 for emergencies such as flat tires, lockouts, or dead batteries. Contact 876-700-0117 or 876-835-5481 in case of breakdown or accident. Do not attempt major repairs or modifications without authorization.

10. Vehicle Condition & Maintenance

• Keep the vehicle clean and in good condition during use.
• Cleaning fees may apply if returned excessively dirty.
• Report any new damage immediately upon return.

11. Termination of Rental

Rental agreements may be terminated without refund if you:

• Violate these Terms of Service.
• Provide false information.
• Use the vehicle recklessly or illegally.

12. Privacy & Data Protection

Personal data collected during booking or rental (ID, contact details, payment info) will be used only for rental purposes and handled according to applicable data protection laws.

13. Limitation of Liability

Explorers Auto Rental Ltd. shall not be liable for:

• Indirect or consequential damages.
• Loss of personal belongings left in the vehicle.
• Delays or service interruptions caused by events beyond our control (e.g., weather, mechanical failure).

14. Governing Law

These Terms of Service are governed by the laws of Jamaica. Any disputes will be handled in the appropriate Jamaican courts.
